brand battle

For more than a century, there’s been a bar fight going on between the world’s biggest brewer, AB InBev (and all its predecessors) and Czech brewer Budejovicky Budvar NP. Both claim they should have the rights to the name “Bud” in Europe.
The most recent winner is AB InBev after the EU General Court in Luxembourg “rejected Budvar’s appeal of AB InBev’s right to the EU trademark because the Czech company presented insufficient proof of the existing use of the name in some European countries,” Bloomberg reports.
Anheuser-Busch InBev NV claims to have been using the Bud name since 1876. Budvar did not exist until 19 years later. AB InBev put in an application for the trademark in July 1996 and, according to the court, Budvar couldn’t show that it had used the term across Europe before then.Continue reading...

The attorneys at the massive AB InBev have been trying to get little Czech brewer Budějovický Budvar to stop using the Budweiser name, but nothing has worked yet and the King of Beers may be seeing its Czech rival in high court as the longrunning dispute continues.
The UK Court of Appeal ruled in favor of Budvar on July 3rd, when the trademark lawyers at Marks & Clark scored the victory for the smaller brewer, according to TheLawyer.com. As it stands now, both brewers are still allowed to use the name Budweiser. And that means, of course, that this legal fight likely isn’t over.
The two companies are now gearing up for an even bigger courtroom battle. If the Court of Appeals had ruled for AB InBev, it would have seriously hurt the smaller Czech brewer, TheLawyer reports.
“This decision confirms what, in our opinion, is obvious following the favorable ruling of the Court of Justice of the European Union in September last year,” said one lawyer for Budvar. “That as a result of the decades-long honest use of the mark Budweiser by both Budvar and Anheuser-Busch in the UK, both parties should be entitled to a trademark registration.”

This Bud's for you. Unless you're in the European Union. In that case, this Budvar is for you.
After a decade and a half battle to trademark the Budweiser brand in European Union, the European Court of Justice has ruled against the AB InBev's "King of Beers" and in favor of its Czech challenger Budvar. Adding insult to injury, AB InBev was ordered to pay Budvar's legal fees.
The Budvar beer brand, headquartered in České Budějovice, may now freely and without concern continue to distribute its brew, known as "Budweiser Budvar," throughout Europe. AB InBev, meanwhile, is wondering what to do next.Continue reading...
